This Public User Agreement (hereinafter referred to as the “Agreement”) is concluded between the User (any capable individual or legal entity) and the Charitable Organization “International Charitable Foundation “Social Projects Center of Future” (hereinafter referred to as the Foundation) and regulates the issues of using the website www.centersocial.org (hereinafter referred to as the “Site”).
1. General Section
1.1. When using the Site and/or any of its parts, the User automatically agrees to the terms of this Agreement.
1.2. The User is obligated to familiarize themselves with the Agreement before using the Site.
1.3. By using any part of the Site, the User agrees to the terms of this Agreement.
1.4. The terms of the Agreement apply to all users of the Site.
2. Rights, Obligations, and Responsibility of the User and the Foundation
2.1. The User has the right to access the Site, including reviewing more detailed information and filling out forms posted on the Site.
2.2. For the violation of the terms of this Agreement, the Foundation has the right to block the User’s access to the Site without prior notice and to delete or edit any data entered by the User.
2.3. If the User believes that there is information on the Site that infringes upon their rights, the User is obliged to notify the Foundation at the following address: office@centersocial.org and provide information confirming such violation of rights. In case the User provides false information about the infringement of their rights, they bear full responsibility for the damage caused (including all expenses, legal fees, and attorney fees, etc.).
2.4. The User is prohibited from:
- Promoting religious, racial, or interethnic enmity;
- Taking actions that violate the rights and freedoms, honor, and dignity of any person;
- Offending anyone;
- Using uncensored expressions, even if they are masked by other symbols;
- Abusing the placement of non-informative data;
- Taking actions aimed at deceiving other users;
- Providing information on behalf of another person is not allowed without prior consent. However, such actions are permitted if the necessary legal powers are obtained in accordance with Ukrainian legislation.
- Posting information (including any materials) that violates the copyright, rights to trademarks, works and services, industrial property rights, and/or rights to other objects of intellectual property owned by third parties;
- Posting information that violates the rights and legitimate interests of third parties, including posting photos and/or videos depicting another person without their consent;
- Posting materials of advertising, erotic, pornographic, or offensive nature;
- Using any computer programs for automated information collection from the Site;
- Conducting illegal collection, systematization, storage, or dissemination of personal information of other users;
- Posting computer viruses or programs capable of disrupting or interfering with the normal functioning of computer equipment and software, as well as means of communication of any persons.
2.5. User Responsibility:
- The User is solely responsible for the use of information posted on the Site.
- The User bears independent responsibility before third parties for their actions or inaction on the Site.
- The User agrees to settle, independently and at their own expense, any claims from third parties related to their actions or inaction on the Site.
- Unless evidence to the contrary is provided, any actions taken by the User are considered their own.
2.6. Foundation Responsibility:
- The Foundation is not liable for third-party use of User-posted information on the Site, including copying, reproduction, and distribution by any means.
- The Foundation does not provide compensation for direct or indirect damages incurred by the User or third parties, whether from the use, non-use, or inability to use the Site.
- The Foundation does not assume obligations to verify, modify, or control the information posted by the User on the Site.
3. Confidentiality
3.1. While using the Site, if the User comes across confidential information about the Foundation and/or third parties, as defined by Ukrainian legislation (including individual information and data restricted by individuals or legal entities, except for authorized entities), or information constituting Commercial Secrecy, the User is prohibited from storing, using, and disseminating such information.
3.2. By visiting and contributing information to the Site, the User acknowledges that, unless access is independently restricted, third parties may have access to the information entered/placed by the User.
4. Other Terms
4.1. The Foundation reserves the right to unilaterally change or update parts of this Agreement at any time without prior notice to the User. All changes to this Agreement become effective upon their publication. In the event that any part of this Agreement is deemed invalid, the remaining parts will remain in effect.
4.2. The Foundation is not responsible for any damage or losses suffered by the User or third parties due to a misunderstanding or lack of understanding of the terms of this Agreement.
4.3. If the User believes that the use of the Site leads to a violation of their rights, the User must immediately cease using the Site.
4.4. The Foundation does not guarantee that the Site meets the User’s goals and expectations, and its constant, uninterrupted, and error-free operation.
4.5. The Foundation has the right to carry out technical and technological updates of the Site and conduct relevant technical work to support and develop it.
4.6. The Foundation may, at any time and without notifying the User, transfer its rights under this Agreement to a third party.
4.7. This Agreement and the relations between the Foundation and the User arising in connection with the use of the Site are governed by the laws of Ukraine. Each party unequivocally agrees that the relevant courts of Ukraine have exclusive jurisdiction over any claims, disputes, or differences related to the Agreement and the use of the Site.
